SECURA Insurance Company for itself and its subsidiaries and affiliates (collectively, “SECURA”), has created mySECURA™ as a web portal for the benefit and convenience of SECURA and its insureds. By using the portal, you agree to be bound by the following terms and conditions:

Unless otherwise expressly stated, the information appearing on mySECURA is provided to you for information purposes only and should not be construed as a solicitation or an offer to sell in connection with any insurance product or service, nor is the information a complete description of all terms and conditions applicable to the insurance products and services described. SECURA does not, in any way, promise that any insurance product or service is, or will remain, available to the public, or that any particular individual will qualify for the products and services offered. SECURA markets all insurance products and services through independent insurance agents in states in which it is authorized to write business. Please contact your independent agent for a complete description of current insurance products and services offered by SECURA. Insurance products and services referenced in mySECURA may not be available in all jurisdictions.

PRIVACY/DATA PROTECTION
The privacy and security of customer information is as important to SECURA as it is to you. SECURA has incorporated physical safeguards, procedural controls, and data access controls to protect your personal and confidential information from unauthorized access.
mySECURA is a restricted site and requires authorization for access. Unauthorized use of or access to restricted areas is prohibited. Attempted or actual unauthorized use or access to such areas may result in criminal and/or civil prosecution. Attempts to access such areas may be viewed, monitored, and recorded. Any information obtained may be given to law enforcement organizations in connection with any investigation or prosecution of possible criminal activity on our system. If you are not an authorized user of mySECURA or do not consent to the continued monitoring, you should not attempt to access the site.
Information provided by you through mySECURA is used for SECURA business purposes only in order to service your needs as a policyholder. You must keep your user name and password secure and notify SECURA immediately if the password becomes known to any unauthorized user or if you suspect that there has been unauthorized use of your password. Any information provided to SECURA subsequent to the use of a password shall remain confidential to the extent reasonably possible.
In using mySECURA, you acknowledge and confirm that the internet is not a secure medium where privacy can be ensured, and that complete security and confidentiality over the internet are not possible at this time. Your confidential use of mySECURA cannot be guaranteed and you acknowledge that your use of mySECURA (including information you transmit to mySECURA) may be subject to access by, or disclosure to, other persons. Without limiting any other disclaimer herein, SECURA shall not be responsible or liable for any harm that you or any other person may suffer in connection with any such breach of confidentiality or security.

TERMINATION
SECURA may terminate the right of any user to access mySECURA at any time, without notice, with or without cause, at SECURA’s sole discretion. The forgoing notwithstanding, access to policy information will immediately terminate sixty (60) days following termination of a policy with SECURA. Thereafter, please contact your agent with respect to access to any policyholder information.
MODIFICATION OF THESE TERMS OF USE
SECURA reserves the right to change the terms, conditions, and notices under which mySECURA is offered, including but not limited to the changes associated with the use of mySECURA. Notice of any such change will be communicated by posting on the mySECURA site. Your use of mySECURA following these changes means that you accept the revised terms.
SEVERABILITY OF PROVISIONS
If any provision of this agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions.
GOVERNING LAW
This agreement shall be governed by and construed in accordance with the laws of the State of Wisconsin, without giving effect to any principles of conflicts of laws.
LIMITATION OF LIABILITY
SECURA WILL NOT BE RESPONSIBLE FOR ANY DAMAGES OR INJURIES THAT ACCOMPANY OR RESULT FROM ANY USE OF OUR SITES. THESE INCLUDE (BUT ARE NOT LIMITED TO) DAMAGES OR INJURY CAUSED BY ANY: (1) USE OF (OR INABILITY TO USE) OUR SITES; (2) USE OF (OR INABILITY TO USE) ANY SITE TO WHICH YOU HYPERLINK FROM OUR SITES; (3) FAILURE OF PERFORMANCE; (4) ERROR; (5) OMISSION; (6) INTERRUPTION; (7) DEFECT; (8) DELAY IN OPERATION OR TRANSMISSION; (9) COMPUTER VIRUS; OR (10) LINE FAILURE. SECURA IS NOT LIABLE FOR ANY CONSEQUENTIAL OR INCIDENTAL DAMAGES, WHICH ARE DAMAGES INTENDED TO COMPENSATE SOMEONE DIRECTLY FOR A LOSS OR INJURY, DAMAGES REASONABLY EXPECTED TO RESULT FROM A LOSS OR INJURY, OR OTHER MISCELLANEOUS DAMAGES AND EXPENSES RESULTING DIRECTLY FROM A LOSS OR INJURY.
IN THE EVENT SECURA MAY BE HELD LIABLE FOR ANY DAMAGES RELATIVE TO OUR SITES, SUCH DAMAGES WILL NOT BE GREATER THAN THE AMOUNT YOU HAVE PAID TO ACCESS OUR SITES.
DISCLAIMER
THE MATERIAL ON OUR SITES IS PROVIDED AS IS. SECURA DISCLAIMS ALL EXPRESS AND IMPLIED WARRANTIES ABOUT THE MATERIAL IN OUR SITES, INCLUDING, BUT NOT LIMITED TO, WARRANTIES THAT: (1) THE MATERIAL IS OF ANY PARTICULAR LEVEL OF QUALITY OR IS FIT FOR A PARTICULAR PURPOSE; (2) THAT THE FUNCTIONAL ELEMENTS CONTAINED IN THE MATERIALS WILL BE UNINTERRUPTED OR ERROR-FREE; (3) THAT DEFECTS WILL BE CORRECTED; (4) THAT OUR SITES, OR THE SERVERS THAT MAKE OUR SITES AVAILABLE ARE FREE OF COMPUTER VIRUSES OR OTHER HARMFUL COMPONENTS OR CONDITIONS; OR (5) THAT INFORMATION CONTAINED IN OUR SITES IS ACCURATE AS OF ANY PARTICULAR DATE.
